Welcome to Simple Beauty Studios North Naples, LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the Simple Beauty Studios mobile application (“App”) and the services we offer through it. You agree not to upload any content that is unlawful, defamatory, obscene, harmful, invasive of another’s privacy, or otherwise objectionable. We reserve the right to remove or refuse any User Content that violates these Terms or is otherwise inappropriate in our sole discretion.

3. End User License Agreement (EULA)

Subject to your compliance with these Terms, Simple Beauty Studios grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your mobile device for personal, non-commercial use only.

3.2 License Restrictions

• Reverse engineer, decompile, or disassemble the App or attempt to derive the source code of the App.
• Rent, lease, lend, sell, redistribute, or sublicense the App.
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks.
• Use the App to transmit any malware, viruses, or other harmful software code.

3.3 Updates and Upgrades
Simple Beauty Studios may provide updates, upgrades, or patches to the App to improve its functionality or address issues. These updates may be automatically installed without notice or consent from you. Your continued use of the App following such updates constitutes your acceptance of any changes.

3.4 Termination of License
Simple Beauty Studios reserves the right to terminate your license to use the App at any time and for any reason, including but not limited to your violation of these Terms. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Using the App for any illegal purpose or in violation of any local, state, national, or international law.

• Attempting to interfere with or disrupt the operation of the App, including by introducing viruses or other harmful code.

5. Intellectual Property

All content and materials available on the App, including but not limited to text, graphics, logos, icons, images, and software, are the property of Simple Beauty Studios or its licensors and are protected by applicable intellectual property laws.

5.2 Limited License

To the fullest extent permitted by law, Simple Beauty Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any User Content or third-party conduct on the App; or (d) any other matter related to the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless Simple Beauty Studios, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

9. Modifications to the Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the App or through other communication channels. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
